Terms of Service

Last updated: 24 August 2026
Draft notice: this is a working draft prepared for Rytecall and has not yet been reviewed by a solicitor. Section 2 in particular — on emergency limitations and liability — should be reviewed by a solicitor before this is relied on publicly, given what Rytecall's service actually claims to do.

These Terms of Service ("Terms") govern your use of Rytecall's AI phone-answering service (the "Service"), provided by David Maxwell, trading as Rytecall ("we", "us", "our"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. What the Service does

Rytecall answers incoming calls to your business on your behalf, distinguishes between genuine emergencies and routine enquiries, and either transfers urgent calls live to a number you provide, or captures a structured message and sends you a summary by email. Additional features — call recording, a custom greeting, business hours, multiple escalation numbers — vary by plan.

2. Important — the Service is not an emergency service

Read this section carefully. Rytecall is software. It's designed to spot the difference between a genuine emergency and a routine enquiry and respond accordingly, but its judgement is not infallible and its output is not guaranteed.

3. Acceptable use

You agree to use the Service lawfully and responsibly. You must not interfere with or disrupt the Service, attempt to bypass access controls, or use the Service to transmit anything unlawful or harmful. We may monitor usage to maintain service quality and protect other customers.

4. The nature of the AI

The Service is powered by artificial intelligence and, while designed to handle calls reliably, may occasionally mishear a caller, misinterpret intent, or omit or distort details in a summary. Performance can vary with caller speech, background noise, and phrasing. You should review call summaries and act on your own judgement, not treat them as infallible.

5. Your responsibilities

You're responsible for how information gathered through the Service is used in your business.

6. Fees and billing

Plans are billed monthly in advance via Stripe, with a set number of included minutes and a per-minute rate for any usage beyond that, as shown on our pricing page. There's no fixed-term contract — you can cancel at any time, effective at the end of your current billing period. Fees already paid are non-refundable except where required by law.

7. Third-party tools

The Service relies on third-party infrastructure, including Retell AI (voice AI) and Twilio (telephony). We're not responsible for outages, errors, or limitations originating from these providers, though we'll work to resolve any issue affecting your service.

8. Intellectual property

All content, code, prompts, and system design used to provide the Service remain the property of David Maxwell, trading as Rytecall, or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the platform without permission.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, including lost income, goodwill, or business opportunity, arising from use of the Service — including from a missed or mishandled emergency call, subject always to section 2 above. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded.

10. Termination

You may stop using the Service at any time by cancelling your subscription. We may suspend or terminate access if you breach these Terms, payment fails, or continued use risks harm to the Service or others.
